This policy explains how we collect, hold, use and disclose personal information. We handle personal information in accordance with this policy and, where applicable, the Privacy Act 1988 (Cth) and the Australian Privacy Principles.

2. What personal information we collect

The information we collect depends on how you deal with us. We collect information that is reasonably needed to respond to your enquiry, assess a project, provide our services, manage an active project or meet our legal and business obligations.

Information you give us

When you use a quote or contact form, call, email, message us, arrange an inspection or engage us, we may collect:

  • your name;
  • phone number and email address;
  • suburb, property address or service location, if you provide it;
  • the service you are interested in;
  • information you provide about the floor, such as surface condition, cracks, existing coatings, intended use, access requirements, project timing and colour preferences;
  • photographs, plans or other project material you choose to send us; and
  • the content of communications between you and us.

Our current website quote form asks for your name, phone number, email address, service type and project message. Some pages may also ask for your suburb or other project details.

Website, analytics and interaction information

When you visit our website, we and the technology providers described below may automatically receive technical and interaction information. This can include your IP address, browser type, device and operating-system information, referring page, pages viewed, date and time of visit, online identifiers, cookies and approximate location derived from your IP address.

As at the date of this policy, the website uses:

  • Google Analytics to measure website traffic and use;
  • Google Tag Manager to manage website tags;
  • Microsoft Clarity to measure website interactions and usability; and
  • Google Maps where a map is embedded on a page.

Microsoft Clarity may collect interaction data such as clicks, scrolling, mouse movement, page interactions and device information. It may generate session recordings, heatmaps and similar website-usage reports. 

Sensitive information

Our ordinary quote and flooring services do not require sensitive information. Please do not send health information, identity documents, financial-account details, criminal-record information or other sensitive information through a website form or ordinary email unless we ask for it and it is necessary for your request.

3. How we collect personal information

We collect personal information directly from you when you:

  • complete a quote or contact form;
  • call, email or message us;
  • arrange a site inspection;
  • provide information about a quote, project, warranty or service question; or
  • send us project material, such as photos or plans.

We collect technical and interaction information automatically when you use the website through cookies and the tools identified in this policy.

If another person, such as a builder or property manager, asks us to contact you, we will use the information they give us only for that enquiry or another purpose permitted by law. We will take reasonable steps to tell you how we collected your information where required.

4. Why we use personal information

We use personal information to:

  • respond to enquiries;
  • arrange site inspections;
  • assess a slab, surface preparation requirements and suitable flooring systems;
  • prepare and send quotes;
  • schedule and provide flooring work;
  • communicate about appointments, access, project scope, invoices, warranty information and aftercare;
  • maintain quote, project and business records;
  • respond to questions, access requests and complaints;
  • protect our website and business from misuse, fraud and security incidents;
  • meet legal, insurance, accounting and record-keeping obligations; and
  • understand how people use our website so we can maintain and improve it.

We do not use quote-form details for general email or SMS marketing unless you separately opt in or another lawful basis clearly applies. See section 10.

5. What happens if you do not provide information

You can browse most of our website without giving us your name, phone number or email address. However, if you do not provide the information needed for an enquiry or quote, we may not be able to contact you, arrange an inspection, assess the work or prepare a quote.

6. How we hold and protect personal information

Website enquiry submissions are processed through the website’s Elementor form system and are stored in the WordPress website database / sent to our business email inbox / transferred to our CRM, name it / retained by our website host, name it. We hold project and communication records in the business systems we use to manage enquiries and services.

We take reasonable steps appropriate to the type of information we hold to protect it from misuse, interference, loss and unauthorised access, modification or disclosure. 

No method of online transmission or storage is completely secure. Please avoid sending unnecessary sensitive information by website form or ordinary email.

We keep personal information only for as long as it is reasonably needed for the purpose for which it was collected, including to manage a quote or project, answer a warranty or service question, meet legal or accounting obligations, or resolve a dispute.

7. Who we disclose information to

We do not sell or rent personal information.

We may disclose personal information only where reasonably necessary for the purposes in this policy, including to:

  • Apex Epoxy Perth personnel who need the information to respond to an enquiry, manage a project or provide customer support;
  • website, email, IT, security, cloud-storage and business-system providers that we use to operate the website and our enquiry or project records;
  • Google, in connection with Google Analytics, Google Tag Manager and Google Maps;
  • Microsoft, in connection with Microsoft Clarity;
  • contractors or service providers involved in delivering the services you request, if required for that work and disclosed to you as appropriate;
  • our professional advisers, insurers or debt-recovery providers where reasonably necessary; and
  • government agencies, regulators, courts or law-enforcement bodies where required or authorised by law.

8. Overseas disclosure and storage

The website uses global technology providers. Google and Microsoft may handle technical and interaction information outside Australia, including in the United States and other countries where they or their service providers operate.

Where the Privacy Act applies and we disclose personal information overseas, we will take the steps required by Australian privacy law in relation to that disclosure.

9. Cookies, Google Analytics, Clarity and Google Maps

Cookies are small data files stored by your browser. Similar technologies can recognise a browser or record activity on a website.

We use cookies and related technologies to operate and protect the website, measure traffic, understand page use and improve website performance. The current site may use Google Analytics cookies with names beginning _ga, and Microsoft Clarity cookies including _clck and _clsk.

You can manage or delete cookies through your browser settings. Blocking cookies may affect some website functions. You can also use privacy controls offered by Google and Microsoft.

When you view a page containing an embedded Google Map, your browser connects to Google. If you follow a link to Facebook, Instagram or another external website, that website handles information under its own privacy policy. We are not responsible for the privacy practices of external websites.

10. Direct marketing

We may contact you about the enquiry you make, your inspection, a quote, an active project, warranty information or directly related follow-up.

We will only send general promotional email or SMS where you have given valid consent or where Australian law otherwise permits it. Each marketing message will clearly identify us and include a simple way to unsubscribe. You can also ask us to stop direct marketing by contacting our Privacy Contact using the details in section 1.

An unsubscribe request does not stop necessary non-marketing communications about an active enquiry, project, appointment, invoice, safety issue or warranty matter.

11. Access and correction

You may ask for access to personal information we hold about you. You may also ask us to correct information that is inaccurate, incomplete, out of date, irrelevant or misleading.

Contact our Privacy Contact by email, phone or post using the details in section 1. Please provide enough information for us to identify the records you mean. We may ask you to verify your identity before giving access or making a correction.

We aim to respond within 30 days. If we cannot provide access or make a requested correction, we will explain why, subject to any legal restrictions that apply, and explain how you can make a complaint.

We will acknowledge your complaint and aim to provide a written response within 30 days. If more time is needed, we will let you know.

13. Data breaches

If we become aware of a suspected data breach, we will investigate it and take reasonable steps to contain it.
